These Terms and Conditions (“Terms”) govern your use of marcwhyte.com (the “Site”), operated by the Marc Whyte Campaign (“Campaign,” “we,” “us,” or “our”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Purpose of the Site
The Site provides information about Marc Whyte, his record and policy positions, campaign news,
and ways to get involved, give budget input, and support the campaign. Content is political
advertising paid for by the Marc Whyte Campaign. The Site is not an official website of the City
of San Antonio, and nothing on it represents an official act or position of the City.

Eligibility
You must be at least 18 years old to make a contribution or sign up to volunteer. By submitting
any form, you confirm that the information you provide is accurate and belongs to you.

Political Contributions
Contributions are processed by a third-party payment provider (currently Anedot) under its own
terms and privacy policy. By contributing, you confirm that:

• The contribution is made from your own funds and not reimbursed by any other person or entity;
• You are a U.S. citizen or lawfully admitted permanent resident;
• You are not a foreign national, and the contribution is not from a corporation or labor organization where prohibited by law; and
• Your contribution does not exceed the limits set by the City of San Antonio campaign finance ordinance and Texas law, currently [insert applicable limit].

Contributions are not tax deductible for federal income tax purposes. We are required by law to
report certain contributor information, including name, address, and in some cases occupation
and employer, to the [City Clerk / Texas Ethics Commission]. We may refund or decline any
contribution at our discretion or as required by law.

User Submissions
When you submit budget input, comments, volunteer information, or other content
(“Submissions”), you grant the Campaign a non-exclusive, royalty-free, perpetual license to use,
reproduce, summarize, and publish that content for campaign and constituent-communication
purposes, without attribution unless you request otherwise. You agree not to submit content
that is unlawful, threatening, defamatory, obscene, infringing, or that impersonates another
person. We may remove or decline to act on any Submission.

Communications and Text Messages
By providing your email address or phone number, you agree to receive campaign
communications from us. If you opt in to text messages, message frequency varies and message
and data rates may apply. Reply STOP to unsubscribe or HELP for help. Consent to receive
messages is not a condition of contributing.

Intellectual Property
All Site content, including text, graphics, logos, photos, and video, is owned by or licensed to the
Campaign and protected by copyright and trademark law. You may share links to the Site and
quote brief excerpts for news, commentary, or personal non-commercial use with attribution. Any
other reproduction requires our written permission.

Links to Other Sites
The Site links to third-party services, including social media platforms, news outlets, and
payment processors. We do not control and are not responsible for their content, policies, or
practices.

Prohibited Use
You agree not to interfere with or disrupt the Site; attempt unauthorized access to any system;
use bots, scrapers, or automated tools to collect data or submit forms; submit false contribution
or contact information; or use the Site for any unlawful purpose.

Disclaimer of Warranties
The Site is provided “as is” and “as available.” We make reasonable efforts to keep information
accurate and current, but we do not guarantee that content is complete, error-free, or up to date,
or that the Site will be uninterrupted or free of harmful components.

Limitation of Liability
To the fullest extent permitted by law, the Campaign and its officers, volunteers, and vendors are
not liable for any indirect, incidental, consequential, or punitive damages arising from your use of
the Site. Our total liability for any claim relating to the Site will not exceed one hundred dollars
($100).

Indemnification
You agree to indemnify and hold harmless the Campaign from any claims, losses, or expenses,
including reasonable attorneys’ fees, arising from your Submissions or your violation of these
Terms.

Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law
principles. Any dispute will be brought exclusively in the state or federal courts located in Bexar
County, Texas.

Changes to These Terms
We may update these Terms from time to time. Thus, we advise you to review this page
periodically for any changes. Changes are effective immediately after they are posted on this
page, and continued use of the Site means you accept the revised Terms.
